If you believe that Buitentrek has infringed your intellectual property rights, we encourage you to contact us according to the procedure described below.
A. PROCEDURE FOR REPORTING INTELLECTUAL PROPERTY INFRINGEMENT: It is our policy to (1) block access to or remove content (including, but not limited to, text, images, and photos) (collectively "Content") that we in good faith believe infringes the intellectual property rights of third parties upon receipt of a complaint; and (2) terminate service for repeat infringers.
If you believe that the Content available on or through the website infringes copyright, or that your intellectual property rights have otherwise been violated, please send a notice of infringement with the following information to the designated agent below:
- Identification of the copyrighted work or other intellectual property that you believe has been infringed on or through the website, including the registration number of this material, if applicable;
- Identification of the Content that you believe infringes the identified copyrighted work or other intellectual property, including (a) a description of how the material in question uses the copyrighted work or other intellectual property in an infringing manner, and (b) a description of the location of the material on or in the website, with sufficient detail so that we can verify the material within the website;
- Your contact information, including your full name, mailing address, phone number, and email address;
- A statement from you that you in good faith believe that the disputed use of the copyrighted work or other intellectual property is not authorized by the copyright owner, its agents, or the law;
- A statement from you, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder; and
- An electronic or physical signature of the person authorized to act on behalf of the rights holder.
B. ONCE PROPER BONA FIDE INFRINGEMENT NOTIFICATION IS RECEIVED BY THE DESIGNATED AGENT: It is our policy to remove or block access to the allegedly infringing Content.
C. PROCEDURE FOR FILING A COUNTER-NOTICE WITH THE DESIGNATED AGENT: If we believe that the removed Content or access to it was blocked in error, or if we believe we have the right to post and use the Content on behalf of the rights holder, its agents, or under the law (including fair use), we will send a counter-notice with the following information to the designated agent below:
- Identification of the Content that was removed or blocked, including a description of where the material appeared on the website before it was removed or blocked;
- A statement from us, under penalty of perjury, that we in good faith believe the Content was removed or blocked due to a mistake or misidentification of the Content;
- Our contact information, including full name, mailing address, phone number, and email address;
- A statement from us that we consent to the jurisdiction of the federal court for the district where our address is located;
- Our electronic or physical signature.
If a counter-notice is received by the designated agent, we may send a copy of the counter-notice to the original complainant and inform that party that we may restore the removed Content or access to it within 10 business days. Unless the rights holder files a lawsuit seeking a court order against the member, the removed Content may be replaced, or access restored, within 10 to 14 business days or longer after receipt of the counter-notice, at our sole discretion.
Please note that under section 512(f) of the DMCA, any person who knowingly misrepresents that Content or activity is infringing may be liable for damages, including attorney's fees.
